Konkretizacija nekaterih dilem delodajalca po prejemu Sklepa o izvršbi za delavca

Abstract

Execution on salary represents a financial burden on the employee's salary in such a way that the employee at the payment thereof receives a lesser amount than has actually earned through their work. The execution on salary is intended for forced debt repayments as the employee itself does not voluntarily repay their depth. Employee did not pay their obligation to the creditor either because he did not want to do this either because he could not do this because, for example, did not have sufficient financial resources. Collected orders or several orders on execution may represent a burden for the employer, in terms of keeping the right order of received orders, the decision about right method of implementation of each order, as to take the account of legal restrictions relating to Execution Law. Employee's existence and the existence of his family members are protected from the social point of view of limiting the amount which must remain the employee after the payment of salary. Employer's liability regarding the correctness of payment procedures is important otherwise it can have financial consequences arising from liability for damages. The employer is in relation to the employee's creditor as debtor who has received the order and has to execute it regardless of the will and desire of the employee, or according to their preferences. The article deals with the theory in the field of execution on the salary of an employee with the most common dilemmas that employer has and it also shows some concrete solutions in practice. The article is suitable for employers who are faced with issues of enforcement on salary and dilemmas, how should the enforcement of orders be made in practice.
